How benefits work in Azerbaijan
with the context that matters.

Azerbaijan combines compulsory medical and social insurance with employer-paid annual leave and family protections. Private non-oil employers use specific payroll contribution rules, including changes introduced in 2026. Additional medical insurance, bonuses and flexible working supplement the statutory baseline, while genuine independent contractors manage their own business-income obligations.

Geographic and worker scope

This guide focuses on nationwide private-sector employment and distinguishes the contribution rules that apply to non-oil employers from other payroll cases. It also outlines genuine independent contractors’ business-income obligations; regional and sector-specific exceptions are not treated as national rules.

Statutory rules can be conditional. “Common” describes employer practice for the stated audience, not a guaranteed entitlement. Follow each topic for eligibility and qualifications. This guide is general information, not legal or tax advice.

Health insurance and healthcare in Azerbaijan

Public healthcare, insurance and everyday wellbeing. Fill local gaps with international health insurance.

StatutoryCountrywide

Mandatory medical insurance

+−

Mandatory medical insurance provides public health protection financed in part through payroll contributions. In non-oil private-sector employment from January 2026, the employer and employee each pay 2% on monthly earnings up to AZN 2,500 and 0.5% on the excess. These compulsory contributions are separate from voluntary private medical insurance and do not describe the treatment limits of a private plan.

Common employer additionCountrywide

Supplementary medical insurance

+−

Employers provide private medical insurance alongside compulsory medical coverage. The employer-selected policy determines participating clinics, treatment and diagnostic benefits, exclusions and whether dependants are covered; payroll medical-insurance contributions remain separate. For example, PASHA Bank provides medical cover including family treatment and dental services; Edutech provides employee private medical insurance from day one. As a narrow product-specific illustration, an emergency-only corporate policy charges AZN 40 per insured person annually for groups of 1–99 employees, with AZN 2,000 insured cover. This emergency product does not price comprehensive private medical insurance or establish a typical employer budget.

Pensions and retirement in Azerbaijan

Saving for the future and protecting income. Offer one retirement plan across countries with an international pension plan.

StatutoryCountrywide

State survivor pension

+−

Eligible family members receive a public pension following the death of an insured breadwinner. This includes children under 18; children whose disability arose before 18; and full-time students up to age 23. Retirement-age parents or spouses and those with specified severe disability can qualify. A non-working specified family member caring for the deceased person’s child or other listed dependent under eight can also qualify. Payment depends on the deceased person’s pension capital and statutory eligibility and continues while the conditions apply; retirement-age recipients receive it for life.

StatutoryCountrywide

State disability pension

+−

An insured worker with an assessed disability can qualify for a public disability pension. For 81–100% impairment, the insurance record must be at least five years and four months for each full year of working age. For 31–80% impairment, the pension-capital requirement also applies: capital must support at least the minimum pension. The payment is based on accumulated pension capital and the statutory calculation, with a minimum monthly pension of AZN 320. A separate social allowance can apply where pension conditions are not met.

StatutoryCountrywide

Compulsory occupational-accident insurance

+−

Employment under a labour contract includes compulsory protection against loss of occupational capacity caused by workplace accidents and occupational diseases. The compulsory insurance protects the insured worker against the financial consequences of work-related injury, alongside mandatory social insurance. The applicable insurance arrangement and legal conditions determine compensation.

StatutoryCountrywide

State old-age pension

+−

The general retirement age is 65 for both men and women from 1 July 2026. Women’s threshold was 64 years and six months from 1 July 2025 through 30 June 2026. A worker qualifies if accumulated pension capital supports at least the minimum pension, regardless of insurance duration; otherwise at least 25 years of insurance record is required, subject to statutory exceptions. The public pension is paid for life and calculated from the person’s pension capital. The minimum monthly labour pension is AZN 320. The scheme covers citizens and qualifying permanent-resident foreigners and stateless people on equal terms.

StatutoryCountrywide

State social insurance and pension funding

+−

Compulsory social insurance finances retirement, sickness, maternity, disability and survivor protections. For non-oil private-sector employment from 2026, the employee pays 3% on the first AZN 200 of monthly earnings and 10% above that. The employer pays 22% on the first AZN 200, 15% on the portion between AZN 200 and AZN 8,000, and 11% above AZN 8,000. Oil/gas and public-sector employment uses the separate standard contribution regime. Contributions finance public protections rather than an optional employer pension account.

StatutoryCountrywide

Unemployment insurance

+−

Employers and employees each contribute 0.5% of earnings to unemployment insurance. The scheme provides income protection for insured workers meeting the statutory termination and insurance conditions. A payroll contribution alone does not guarantee payment after every resignation or dismissal.

StatutoryCountrywide

Redundancy and liquidation severance

+−

On liquidation or redundancy, employer-funded severance is one average monthly wage for service under one year, at least 1.4 times average monthly wages for one to five years, at least 1.7 times for five to ten years, and at least twice for over ten years. These payments are separate from redundancy notice or agreed compensation replacing notice. A worker called up for military service receives at least three average monthly wages under the amended rule. Death during employment gives heirs a payment of at least three average monthly wages; other statutory termination grounds have their own payment rules.

Common employer additionCountrywide

Supplementary pension support

+−

Employers offer pension support in addition to mandatory public social insurance. The employer arrangement sets contributions, employee participation and the terms for receiving retirement savings or benefits.

Paid leave and sick pay in Azerbaijan

The legal baseline and additional time away.

StatutoryCountrywide

Additional statutory annual leave

+−

Service with the employer adds two calendar days after five to ten years, four days after ten to fifteen years and six days after more than fifteen years. Qualifying harmful or heavy work carries at least six additional calendar days. Women with two children under 14 receive two additional days; three or more children under 14, or a child with disabilities, gives five days. The child-related entitlement also covers fathers raising children alone and adoptive parents.

StatutoryCountrywide

Annual paid leave

+−

Employees receive at least 21 calendar days of paid annual leave. Managers and specialists and other listed occupations qualify for 30 calendar days. Part-time employees receive the same leave duration for their role as full-time staff; seasonal employees receive at least two calendar days per month worked. Non-working public holidays falling during leave are excluded from its calendar-day count. First-year leave normally becomes available after six months of work, with statutory exceptions and earlier leave possible by agreement. The employer pays the statutory average wage for leave; the current law protects payment at no less than the last wage.

StatutoryCountrywide

Sickness benefit

+−

For illness starting on or after 1 May 2026, an insured employee with at least six months of social insurance receives a benefit based on 100% of calculated earnings, supported by an electronic medical certificate. Earnings are calculated using the preceding four consecutive quarters and excluded-day rules. The employer funds the first 14 calendar days of an episode, and compulsory social insurance funds subsequent days, up to one year. The monthly amount is capped at 25 times the minimum monthly labour pension and twice the employee’s monthly wage, with exceptions for occupational accidents and diseases. Continuous certificates do not restart the employer-funded period; separate illness episodes do.

StatutoryCountrywide

Unpaid family and personal leave

+−

On request, employees can take up to 14 calendar days a work year to care for a sick family member when supported by a medical opinion. Women and single parents or guardians with children under 16 have up to 14 calendar days, as do specified employees caring for children with disabilities. Up to seven calendar days is available for family, domestic and other social matters. An employer and employee may also agree unpaid leave of up to six months. These periods preserve time away from work without creating an employer salary payment.

Maternity, paternity, and parental leave in Azerbaijan

Leave, pay and support through life’s changes.

StatutoryCountrywide

Maternity leave and insurance payment

+−

Maternity leave is 126 calendar days: 70 before childbirth and 56 after. A difficult birth or multiple birth extends the postnatal portion to 70 days. If childbirth occurs after the expected date, paid prenatal leave extends without reducing postnatal leave. In agricultural production, totals are 140 days for normal birth, 156 for difficult birth and 180 for multiple birth. An insured woman needs six months of social insurance to receive the maternity allowance. For events starting from 1 May 2026, the fund pays calculated average daily earnings for the calendar days of leave, based on four preceding quarters, subject to a monthly cap of 25 times the minimum monthly labour pension. The medical institution issues an electronic certificate and the employer records the leave order for automated assignment.

StatutoryCountrywide

Paid paternity leave

+−

A father receives a total of 14 calendar days of paid leave around the birth of his child. He submits a medical certificate confirming the birth; the employer creates the leave order in the national electronic Labour and Employment system under Article 125(4) of the Labour Code. This is separate from the older unpaid-leave provision for a man whose wife is on maternity leave.

StatutoryCountrywide

Adoption leave

+−

A woman adopting a child younger than two months receives the 56-day paid social leave established after childbirth. She also has access to applicable additional leave for parents and partially paid childcare leave until age three. Adoption leave is an employee entitlement; it does not create paid time away from work for a self-employed contractor.

StatutoryCountrywide

Childcare leave until age three

+−

An employee directly caring for a child can take partially paid social leave until the child turns three. One parent or another family member providing care can use it in full or in parts by written application. The social insurance allowance is AZN 44 per month until age one and a half and AZN 28 per month from one and a half to three. For a child with disabilities the allowance doubles. The allowance ends if the worker returns early or voluntarily terminates employment.

StatutoryCountrywide

One-off childbirth allowance

+−

The State Social Protection Fund pays AZN 600 for each registered live birth. Multiple births receive the amount for each child. The allowance is assigned proactively after birth registration. Where the mother is unemployed or absent, the employed father receives the insured-parent payment. Stillbirth does not qualify.

Common employer additionCountrywide

Additional family and childcare support

+−

Employers offer family and childcare support beyond statutory leave and social allowances. The employer policy determines eligible family members, the form of assistance and any reimbursement conditions. As an employer example, PASHA Bank supports preschool preparation, kindergarten and school payments.

Common employer additionCountrywide

Performance bonuses

+−

Employers use performance bonuses to reward individual or company results. The employment contract or bonus policy sets targets, assessment periods, discretion and payment conditions; the award is additional to ordinary salary. As an employer example, Andersen’s Azerbaijan careers page offers monthly bonuses.

Flexible work and everyday life in Azerbaijan

Flexibility, learning and day-to-day support.

StatutoryCountrywide

Statutory study leave

+−

Employees studying alongside work receive education leave for eligible study and examinations. Correspondence higher-education students receive 30 calendar days in each of the first two academic years and 40 in later years; secondary-specialist students receive 20 then 30 days. State examinations carry 30 days. Diploma preparation and defence carry up to four months in higher education or two months in secondary-specialist education. Vocational students studying without leaving work receive 30 days per academic year for examinations; general-education correspondence students receive 20 days for graduation examinations. The Labour Code provides average-wage protection for qualifying paid educational leave.

Common employer additionCountrywide

Meal support

+−

Employers provide meal allowances as an addition to salary. The employer policy determines the allowance, payment frequency and eligible meals or expenses. As an employer example, Future Lab provides a corporate lunch service with a customisable weekly menu.

Common employer additionCountrywide

Commuting support

+−

Employers provide transportation allowances to help with travel to work. The policy sets the amount and eligible travel arrangements.

Source: Redii market review, 2026

Common employer additionCountrywide

Flexible and remote work

+−

Employers offer flexible working arrangements. Remote work can be agreed through the employment contract, which sets additional working conditions and use of electronic or software tools. Work location, schedules, availability and support should be specified in the arrangement. As a technology-employer example, Andersen offers employees a choice between remote and office work; moving temporarily to another company office requires project-manager approval. Edutech combines core hours with flexible scheduling and remote days where projects permit.

Common employer additionCountrywide

Employer-funded professional development

+−

Employers support professional development through job-related training and skills development. The agreed programme determines course access, funding and any repayment conditions. As a technology-employer example, Andersen pays for courses and certifications relevant to an employee’s specialisation. Edutech covers role-relevant exam fees and preparation and includes study time.

Hiring employees in Azerbaijan: what affects benefits

Employment context that affects the benefit package.

StatutoryCountrywide

Employee and independent-contractor classification

+−

A genuine independent contractor supplies services under a civil arrangement. Employee protections cannot be avoided by naming an employment relationship a services contract. The Labour Code requires employment treatment when its statutory indicators apply, including engagement in the employer’s main business activity or terms that regulate employee duties, leave and employment safeguards. Classify the actual work relationship before assigning leave, payroll and insurance obligations.

StatutoryCountrywide

Employment contracts

+−

Employment normally starts through an electronic employment contract in the national information system, with limited statutory exceptions. Indefinite contracts are the default where duration is not specified, and normally apply to continuing work unless a statutory fixed-term ground applies. A fixed-term relationship continuing uninterrupted for more than five years becomes indefinite. The contract must set out the parties, role, working arrangements and remuneration required by the Labour Code.

StatutoryCountrywide

Salary payment and final pay

+−

Salary must be paid at least monthly. By mutual agreement, it can be split into an advance and balance twice a month, with no more than 16 days between payments. If payday falls on a rest day or non-working holiday, payment is made on the preceding day. All sums due on leaving employment are paid on the termination day. The employer must provide the statutory payroll calculation details.

StatutoryCountrywide

Minimum wage

+−

The minimum monthly wage is AZN 400 from 1 January 2025. A full-time employee who fulfils the required working time and duties must receive at least this amount. The floor is a legal minimum rather than a benchmark salary for skilled professional work.

StatutoryCountrywide

Working hours and overtime

+−

Normal working time is at most eight hours a day and 40 hours a week, usually over five days. Six-day schedules can operate within the weekly limit. Overtime is limited to four hours over two consecutive working days, or two hours in harmful or heavy work. For time-paid employees, overtime receives at least twice the hourly tariff wage; the law uses a separate additional-pay formula for piecework. Overtime cannot be replaced by extra rest days. Shorter statutory hours apply to specified young workers, disabled workers, pregnant employees and other protected groups.

StatutoryCountrywide

Probation

+−

Probation must be specified in the employment contract and is normally limited to three months. A contract of up to six months has a maximum two-week probation; contracts up to two months and protected employee groups cannot have probation. Before probation expires, either party gives three days’ written notice to end the contract; an employer must substantiate an unsuccessful probation decision.

StatutoryCountrywide

Termination grounds and notice

+−

An employer must rely on a lawful ground for termination and follow the applicable Labour Code procedure. For redundancy, minimum notice is two calendar weeks below one year of service, four weeks for one to five years, six for five to ten years, and nine for over ten years. During notice the employee receives at least one paid working day each week to seek work. With the employee’s agreement, the employer can replace those notice periods with 0.5, 0.9, 1.4 or 2 average monthly wages respectively. Employee resignation normally requires one calendar month’s written notice, with specified statutory exceptions.

StatutoryCountrywide

Employee income tax in 2026

+−

In non-oil private-sector employment during 2026, taxable monthly income up to AZN 2,500 is taxed at 3%; the next bracket is AZN 75 plus 10% of income above AZN 2,500; above AZN 8,000 the tax is AZN 625 plus 14% of the excess. The AZN 200 monthly-income exemption remains where monthly income is at most AZN 2,500. Oil/gas and public-sector employees have separate tax rules. These are tax calculations on taxable income, not employer benefit budgets.

Different working relationship

Contractor benefits in Azerbaijan

A genuine independent contractor provides services under a civil arrangement and does not automatically receive employee leave or employer benefits. Contractors handle their own business-income and social-insurance obligations under the applicable rules; an employment relationship in practice can trigger employee protections regardless of the contract label.
