Benefits in India,
with the context that matters.
India combines legally required social insurance for healthcare and retirement and leave protections with employer-funded medical, life, accident, retirement and incentive benefits. The four national labour codes took effect on 21 November 2025, while eligibility and leave details still depend on state rules, establishment coverage, wages and worker status. A benefit package should distinguish the statutory baseline from the company’s own plan and allowances.
State rules, establishment coverage, wages and worker status affect how the national framework applies. The holiday calendar below covers central-government offices in Delhi/New Delhi only.
Statutory vs employer benefits in India
Start with the baseline. See where employers add more.
Statutory rules can be conditional. “Common” describes employer practice for the stated audience, not a guaranteed entitlement. Follow each topic for eligibility and qualifications. This guide is general information, not legal or tax advice.

StatutoryCountrywideEmployees’ State Insurance healthcare and cash benefits
+−
Employees’ State Insurance healthcare and cash benefits
The Employees’ State Insurance (ESI) system, funded by employer and employee payroll contributions, combines medical care for insured employees and eligible family members with cash benefits for sickness, maternity, disability and employment injury. The cited employee wage ceiling is ₹21,000 per month (₹25,000 for employees with disabilities); standard contributions are 3.25% of wages from the employer and 0.75% from the employee. Coverage depends on the establishment and worker eligibility. Employees outside ESI commonly rely on public services and may receive employer group medical insurance; ESI is not a private insurance policy.
Common employer additionCountrywideEmployer group medical insurance
+−
Employer group medical insurance
Employer group medical insurance can pay for hospital and inpatient care where public services or Employees’ State Insurance (ESI) do not meet a worker’s needs. In a benefits provider’s financial-year 2026 employer-plan book, the median insured sum is INR 500,000 for the employee and covered family. The employer arrangement determines employee and family eligibility, premium funding, covered services and claims terms.
Common employer additionCountrywideWellness allowance
+−
Wellness allowance
A common wellness allowance reimburses approved fitness, preventive-care or wellbeing expenses up to a set budget. An illustrative package allocates USD 175–250 a month. The employer defines eligible purchases, invoices, unused balance and tax treatment. The amount is a package example and must be compared with local-currency payroll costs before adoption.

Some employersCountrywideSupplementary dental cover
+−
Supplementary dental cover
Supplementary employer dental cover can reimburse eligible dental consultations and treatment alongside group medical insurance. Dental cover is less common than core group medical cover. The employer and insurer set covered services, limits, family eligibility and any employee contribution.

Some employersCountrywideOptical and vision cover
+−
Optical and vision cover
Supplementary employer vision cover can contribute towards eligible eye care alongside group medical insurance. Vision cover is less common than core group medical cover. The policy determines covered examinations or treatment, reimbursement limits and eligible family members; a medical policy does not automatically include a glasses allowance.

Some employersCountrywideMental-health treatment and support
+−
Mental-health treatment and support
Group medical plans can cover psychiatric hospitalisation and offer counselling that does not require a hospital stay or a confidential employee assistance service for counselling and referrals. Counselling sessions, remote therapy, crisis access and confidentiality depend on the actual policy; inpatient psychiatric cover alone does not promise such a counselling service.
Pensions and retirement in India
Saving for the future and protecting income. Offer one retirement plan across countries with an international pension plan.
StatutoryCountrywideProvident fund and pension contributions
+−
Provident fund and pension contributions
Covered employers and employees generally contribute 12% each of qualifying wages to the Employees’ Provident Fund (EPF), a payroll-funded retirement savings system, with the employer share allocated among provident fund, pension and linked insurance accounts under scheme rules. Mandatory coverage administered by the Employees’ Provident Fund Organisation (EPFO) now extends to employees with monthly wages up to INR 25,000 from 17 September 2026; payroll calculations must use the current ceiling. Establishment coverage, existing membership, higher-wage contributions and international-worker agreements affect the calculation. The client of a genuine independent contractor does not make the employee contribution merely because it pays an invoice.
StatutoryCountrywideGratuity on separation
+−
Gratuity on separation
Gratuity is a legally required lump-sum payment from the employer when qualifying employment ends, ordinarily after five years of continuous service. An eligible direct fixed-term employee qualifies after one year under the current code, while death and disablement have separate exceptions. The usual calculation is 15 days of last-drawn statutory wages for each completed year of service, with the new wage definition effective 21 November 2025. For contract labour, the contractor as employer bears gratuity liability under the code. This payment is separate from pay instead of a notice period.
Common employer additionCountrywideGroup accident and disability insurance
+−
Group accident and disability insurance
Group personal-accident cover supplements mandatory employment-injury protection. Group personal-accident cover can pay for accidental death, permanent or temporary disability, fracture, burns and related costs. The insurer defines covered injuries, eligibility, insured amounts and exclusions; the employer sets premium funding.
Common employer additionCountrywideSupplementary employer pension contribution
+−
Supplementary employer pension contribution
Supplementary employer pension contributions are a common optional benefit in Indian employer packages. Employers pay into a retirement savings arrangement in addition to mandatory retirement contributions. One illustrative package specifies a 10% employer contribution; the plan must state what this percentage applies to. The employer policy sets the actual rate, eligibility and any conditions for the employee to retain the employer-funded amount.

Some employersCountrywideGroup term life insurance
+−
Group term life insurance
Group term-life insurance pays a nominated beneficiary when an insured employee dies during covered employment. The employer chooses whether to buy the policy, its insured sum and eligibility. Personal-accident and disability cover have different claim triggers and sums insured. Among self-funded information-technology employers in a benefits provider’s financial-year 2026 plan book, 17% of plans included group term life.

StatutoryCountrywideEarned annual leave and state/sector leave
+−
Earned annual leave and state/sector leave
Under the Occupational Safety, Health and Working Conditions Code, a covered worker who works at least 180 days in a calendar year earns one paid day for every 20 days worked; different accrual applies to adolescent workers and underground miners. A worker joining after 1 January can qualify after working one-quarter of the remaining calendar year. The code’s leave provisions cover workers and supervisors earning no more than INR 18,000 per month, rather than every manager or corporate employee. Up to 30 days ordinarily carry into the next year; refused leave carries without that cap, and unused credit is encashable on separation. State Shops and Establishments laws govern working conditions for many shops and offices; these laws and more favourable employment terms can add rights for offices and other employees.
Common employer additionCountrywideAdditional employer annual leave
+−
Additional employer annual leave
Additional annual leave above the applicable state, sector or establishment minimum is a common employer benefit. An illustrative package adds five to nine paid days. The contract must define whether these are working or calendar days, how leave accrues, carry-forward rules, approval and payment for unused leave when employment ends. Additional days are separate from local public holidays.

Maternity, paternity, and parental leave in India
Leave, pay and support through life’s changes.
StatutoryCountrywidePaid maternity leave and childcare facilities
+−
Paid maternity leave and childcare facilities
Under the Social Security Code, a qualifying woman receives 26 weeks of paid maternity benefit for the first two surviving children, with no more than eight weeks before expected delivery; after two surviving children the entitlement is 12 weeks, with no more than six weeks before delivery. She generally needs 80 days of work in the preceding 12 months. A woman adopting a child under three months, or a mother whose child is born through a surrogacy arrangement, receives 12 weeks from handover. Miscarriage or medical termination brings six weeks of paid leave with prescribed proof; related illness can add up to one month. The employer pays the statutory benefit at average daily wages unless maternity cash benefit under Employees’ State Insurance (ESI) applies. Establishments with at least 50 employees must provide access to a childcare facility regardless of employee gender. Suitable work from home after maternity leave can be agreed.
Common employer additionCountrywideEmployer partner and paternity leave
+−
Employer partner and paternity leave
A private-sector employer commonly offers one to two weeks of paternity or partner leave as a discretionary policy. Some packages extend this to 10–15 days. The contract controls who qualifies, whether weekends count and whether leave is paid and at what rate. There is no uniform national statutory private-sector paternity entitlement.

StatutoryCountrywideStatutory annual bonus
+−
Statutory annual bonus
Covered employers must pay an eligible employee who has worked at least 30 days in the accounting year a minimum bonus of 8⅓% of qualifying annual wages, subject to the notified wage eligibility and calculation ceilings. The code caps the statutory bonus at 20% of wages. A performance award paid under a separate plan is not the same as this legal bonus.

Common employer additionCountrywidePerformance bonus and commission
+−
Performance bonus and commission
A commonly used employer performance bonus or commission pays variable cash according to sales, individual results or company outcomes. The plan defines targets, measurement period, discretion, proration and payout after departure. Annual performance incentives are excluded from the labour-code wage definition for specified wage-linked calculations; they must be kept separate from the statutory minimum bonus for eligible employees.

Some employersCountrywideEmployee share options and restricted shares
+−
Employee share options and restricted shares
Options to buy shares and share awards subject to plan conditions give selected workers a potential stake in company value. The plan sets the award size and when rights become earned. It also states any price to buy shares through an option, how shares or cash are valued when delivered, when tax is due, what happens if the worker leaves and how shares may be sold. The award is not immediately spendable cash, and shares may not be immediately saleable. A phantom award pays cash linked to share value without giving ownership. Genuine contractors require an express award and separate tax review.

Meal vouchers and food allowance
A common meal benefit can provide employer-funded food vouchers or let employees allocate part of salary to a meal card. An illustrative employer-funded package budgets USD 75–150 a month for meals. The employer policy sets funding, eligible purchases, unused-balance rules and tax treatment.

+−
Fuel, driver and company-car support
Common optional transport packages can provide a company car, fuel card, driver or reimbursement for business travel. The employer sets eligible role, private-use rules, maintenance and tax treatment. A fuel benefit is distinct from everyday commuting reimbursement and from paying for occasional business trips.

Common employer additionCountrywideWork-from-home allowance
+−
Work-from-home allowance
A work-from-home allowance is a common optional benefit for India-based employees. An illustrative package allocates USD 150–200 per month toward approved remote-work costs. The employer policy must state which expenses qualify, whether receipts are required, and how recurring costs differ from one-time equipment purchases. If equipment is funded, the policy should also state ownership, replacement and return rules.

Common employer additionCountrywideInternet and phone reimbursement
+−
Internet and phone reimbursement
Indian employers commonly reimburse the connectivity needed for remote work, including home internet and mobile service. The policy should set monthly caps, eligible bills, business-use evidence and whether the company supplies a separate device. Reimbursement for actual work costs differs from a cash allowance that becomes ordinary remuneration.

Common employer additionCountrywideEducation and professional learning support
+−
Education and professional learning support
A common employer education allowance can pay for courses, certifications, conferences or job-related study. The employer defines eligible programmes, approval, annual budget and any repayment agreement if an employee leaves after funded training. Work-required training is usually paid directly by the employer rather than treated as a personal perk.

Hiring employees in India: what affects benefits
Employment context that affects the benefit package.
StatutoryCountrywideEmployee, contract labour and independent contractor
+−
Employee, contract labour and independent contractor
India distinguishes employees hired directly, labour employed by a contractor and genuinely independent service providers. A contract-labour worker can still receive legally required wages and, on qualifying employment ending, a gratuity lump sum from the contractor as employer; this is not the same as a freelance client paying an invoice. Control, integration, employer identity and the actual work arrangement determine which labour-code duties apply.

StatutoryCountrywideDirect fixed-term employment
+−
Direct fixed-term employment
A fixed-term employee is engaged directly by the employer for a specified period; this category is distinct from labour supplied by a third-party contractor and from a genuine independent contractor. Current labour-code guidance gives a direct fixed-term employee eligibility for the employer-paid lump sum due when qualifying employment ends (gratuity) after one year of contract service. The written agreement should state duration, role, pay, benefits and what happens at expiry.

StatutoryCountrywideWritten appointment letter
+−
Written appointment letter
A covered establishment must issue every employee an appointment letter when the employee is hired. The Occupational Safety, Health and Working Conditions Code requires the letter to contain information and follow the form prescribed by the appropriate government; state or sector rules may add particulars. The duty also applied to existing employees who lacked a letter, with a three-month transition from the code’s 21 November 2025 commencement.
StatutoryCountrywideWage definition and allowance calculation
+−
Wage definition and allowance calculation
The labour-code definition of wages has applied since 21 November 2025. Basic pay, dearness allowance (cost-of-living pay) and retaining allowance (pay to keep a worker available between work periods) form the core; if excluded components exceed half of total remuneration, the excess is added back for wage-linked calculations. Employer provident-fund and pension contributions and statutory bonus are considered in that 50% calculation, while gratuity (an employer-paid lump sum when qualifying employment ends) and Employees’ State Insurance (ESI) contributions are not. Annual performance incentives are excluded from wages under the code.

StatutoryCountrywideWage period and final wages
+−
Wage period and final wages
An employer may set a daily, weekly, fortnightly or monthly wage period, but none may exceed one month. Monthly wages are due within seven days after the period ends. Wages due on dismissal, removal, retrenchment (job loss because the employer no longer needs the work) or resignation are payable within two working days under the Code on Wages, subject to any valid more specific government time limit.

StatutoryCountrywideMinimum wage and wage-floor setting
+−
Minimum wage and wage-floor setting
The appropriate central or state government sets the legal minimum wage for covered work; there is no single pay rate for every Indian occupation and location. The current Code on Wages extends timely payment protections to employees and prohibits paying less than the applicable notified minimum. Employers must identify the location, scheduled work and skill classification before setting base pay.

StatutoryCountrywideWorking time and overtime pay
+−
Working time and overtime pay
For workers covered by the Occupational Safety, Health and Working Conditions Code, the standard is eight hours a day. Work beyond eight hours in a day or 48 hours in a week attracts twice the normal wage rate, paid at the end of the wage period. The precise rule can depend on the worker category and appropriate government’s rules; a salaried job title alone does not remove wage-code overtime eligibility.

StatutoryCountrywideIndustrial worker retrenchment notice and compensation
+−
Industrial worker retrenchment notice and compensation
Under the Industrial Relations Code, a covered worker employed continuously for at least one year cannot ordinarily be retrenched—that is, dismissed because the employer no longer needs the work—until given one month’s written notice with reasons or pay instead of the notice period, and compensation equal to 15 days’ average pay for each completed year of service or part over six months. Government notice is also required. A separate chapter imposes prior permission and longer notice on qualifying larger industrial establishments. This rule concerns covered workers and retrenchment; it is not a nationwide one-month termination or severance entitlement for every office employee. Employment contracts and state rules may add duties.
StatutoryCountrywideForeign employee employment visa
+−
Foreign employee employment visa
A foreign national coming to India to work for an Indian organisation generally needs an Employment Visa supported by proof of appointment and employment terms. The government visa schedule describes an initial grant of one year or the contract period, with extension possible. A business-visit or tourist permission should not be treated as authority to perform local employment. Nationality, role, salary and visa-category exemptions can alter the route, so the sponsoring employer must check the candidate’s permission before work begins.
Contractor benefits in India
Employee benefits should not be assumed to cover independent contractors. A genuine contractor’s arrangement with a client is separate from the statutory employee benefit package.
