Benefits in Honduras,
with the context that matters.

Honduran employee benefits combine public social insurance, paid annual leave, public holidays, maternity protection, mandatory additional salary payments and qualifying termination benefits. Private medical insurance can supplement public cover. Remote employment can be agreed within the national telework framework. Genuine independent contractors operate under a different service and tax relationship; employee protections depend on the substance of the working arrangement.

Benefits for employees in Honduras

This guide covers employees and genuine independent contractors working in Honduras. Statutory leave and social-insurance benefits depend on employment status, service, insured earnings and applicable scheme coverage. Public holiday rules include the October transfer period.

StatutoryCountrywide

Public social health insurance

+−

The Honduran Social Security Institute administers public social insurance for medical care, sickness and maternity. Covered employees are registered through their employer and contributions fund the insured system. Medical services include consultations, hospitalization, medicines and maternity care under the scheme’s eligibility and service rules. Coverage has been introduced progressively by worker category and geographic area; scheme membership does not establish identical local access everywhere. Private medical insurance can supplement this public baseline.

Some employersCountrywide

Supplementary private medical insurance

+−

Some private-sector employers provide supplementary medical insurance to give employees access to private hospitals, clinics and specialists in addition to public social insurance. The employer can fund the premium fully or share it with the employee. The policy determines covered treatment, provider network, employee cost and whether dependants can join. Premiums depend on coverage, age and dependant inclusion.

Pensions and retirement in Honduras

Saving for the future and protecting income. Offer one retirement plan across countries with an international pension plan.

StatutoryCountrywide

Occupational injury and disability protection

+−

Public social insurance covers work accidents and occupational disease for insured employees. A work-related incapacity does not require the ordinary prior contribution waiting period for sickness cash benefits. Permanent occupational disability can qualify for a pension after medical assessment; a degree above 15% is the threshold stated in the application regulations. Employer safety duties and any direct compensation obligations remain separate from insurance administration.

StatutoryCountrywide

Public pension and survivor insurance contributions

+−

The Honduran Social Security Institute runs the compulsory invalidity, old-age and survivor insurance branch for covered employees. The statutory pension-branch contribution is 3.5% for the employer and 2.5% for the employee, with the State contributing 0.5% under the scheme’s funding rules. These rates apply to the insured contribution base subject to the applicable ceiling; they are not unlimited percentages of every employee’s full salary. Pension and survivor eligibility depend on the insured risk and contribution history.

StatutoryCountrywide

Employer-funded individual labor reserve

+−

The Private Contributions Regime, the Honduran institution administering worker savings funds, maintains an individual labor reserve funded by the employer. The contribution is 4% of ordinary monthly salary, capped at three times the highest applicable minimum wage. Private businesses whose employment relationships fall under the Labor Code must register, with the stated exception for approved annual severance-delivery agreements.

The worker can receive the full accumulated reserve when the employment relationship ends for any reason. This funded balance is separate from assessing the employer’s remaining severance liability; payroll administration must apply the statutory offset and withdrawal rules.

StatutoryCountrywide

Severance for qualifying termination

+−

For qualifying termination of indefinite employment, severance is ten days’ salary after three to six months of continuous service, twenty days after more than six months but less than one year, and one month per year thereafter with proportional service calculation. The general ceiling is 25 months’ salary. A microenterprise with no more than ten paid employees has a 15-month ceiling instead.

A qualifying voluntary resignation after at least 15 years can receive 35% of the otherwise applicable amount; this rule does not apply to microenterprises. Natural death after more than six months can produce a 75% payment to beneficiaries, subject to the statutory exclusions and insurance protections. For an unjustified early end to a lawful fixed term or project, compensation is the remaining salary, capped by the corresponding indefinite-contract amount. Justified dismissal and protected-status cases require their own assessment.

Supplementary retirement savings and matching

+−

Some employers, especially multinationals, supplement the public pension with a voluntary retirement savings plan. A defined-contribution arrangement builds an individual account from employer and employee payments. An employer can also match an employee’s contribution under the plan rules. The agreement specifies contribution levels, eligibility, investment administration and access to the accumulated savings.

Paid leave and sick pay in Honduras

The legal baseline and additional time away.

StatutoryCountrywide

Paid annual vacation

+−

Paid annual vacation increases with completed continuous service at the same employer: 10 consecutive working days after one year, 12 after two years, 15 after three years and 20 after four or more years. Part-time work does not itself remove the vacation right.

The employer schedules vacation within three months after it becomes due, gives at least 10 days’ notice of the start, and pays the vacation amount at least three days before it starts. Pay uses average ordinary earnings over the preceding six months, or the shorter period worked, including qualifying pay in kind. Vacation is normally taken as time off. A one-time accumulation of up to two years is allowed for technical, managerial or similarly difficult-to-replace roles. Earned unused vacation is payable on termination; proportional rights before full eligibility depend on the termination circumstances.

Social insurance sickness cash benefit

+−

Insured employees unable to work through illness or accident can receive a sickness subsidy from the fourth day. The usual maximum is 26 weeks; medical authorization can extend this first by 13 weeks and then by another 13, for up to 52 weeks in total. The ordinary eligibility threshold is 35 contribution days in the preceding three calendar months and insured work at the start of incapacity. The contribution waiting requirement does not apply to occupational risks.

The cash subsidy is normally 66% of the insured daily salary base. It is 50% when the insured person is hospitalized and has no financial dependants. Certification and any extension must follow the social insurance procedure. These insurance payments do not themselves establish a universal employer top-up to full actual salary.

StatutoryCountrywide

Serious family emergencies and civic leave

+−

Employees must be allowed time away for legally imposed public duties, a proven serious domestic emergency, qualifying union assignments and a coworker’s funeral. Give timely notice and substantiate the reason. Absences for union assignments and coworker funerals must not prevent the business from functioning.

The general employer-paid limit for these reasons is two days per calendar month and no more than 15 days in a year. Permanent public commissions, elected office and union leadership have separate leave and return-to-work rules. Collective agreements or employment terms can provide more generous leave.

Leave, pay and support through life’s changes.

StatutoryCountrywide

Insured maternity rest and cash subsidy

+−

The Honduran Social Security Institute, the public social insurance administrator, certifies 42 days of prenatal rest and 42 days after birth. The maternity cash subsidy is 66% of the insured daily salary base, rather than an automatic 66% of uncapped actual salary. Eligibility requires at least 75 contribution days in the ten months before prenatal rest and insured employment when that rest starts.

The employee must stop remunerated work during certified rest. Early delivery shortens prenatal subsidy; a later delivery can require additional medically certified prenatal rest. The temporary-incapacity rules allow up to 14 additional calendar days for a birth after the expected date. The employer’s separate maternity-pay obligation supplements the insurance payment under the Labor Code.

StatutoryCountrywide

Maternity leave and employer pay protection

+−

The Labor Code gives a birth parent 10 weeks of paid maternity rest: four before birth and six after. The employee keeps the job and contractual rights. A medical certificate must identify the pregnancy, expected birth date and leave start, with leave beginning at least four weeks before birth.

The employer pays the difference between the social insurance maternity subsidy and the remuneration protected by the Code. Where the social insurance institution is not obliged to pay a subsidy, the employer bears the maternity-pay obligation in full. Variable pay is assessed using the applicable prior-earnings rule. Insured maternity certification separately provides 42 days before and 42 days after birth.

StatutoryCountrywide

Pregnancy loss, recovery and paid feeding breaks

+−

A miscarriage or non-viable premature birth gives a medically certified two to four weeks of paid leave under the Labor Code. Illness caused by pregnancy or childbirth can extend protected paid recovery for up to three months; further medically necessary recovery preserves the job and acquired rights but is normally unpaid unless better terms are agreed.

For the child’s first six months, a working mother is entitled to two paid 30-minute feeding breaks during the working day. Additional breaks require medical justification. Employers must provide an appropriate adjacent nursing or childcare space or arrange the service through a childcare institution.

Public holidays in Honduras

Employees receive paid public holidays in addition to annual vacation. In October, the three civic holidays are transferred into Semana Morazánica, the three-day holiday block; the 2026 calendar gives the specific dates. If employees work on an agreed public holiday, the hours are paid at double the ordinary rate.

Employees receive paid public holidays in addition to annual vacation. Monthly and fortnightly salary already includes unworked paid holidays. Agreed work on a public holiday is paid at double the ordinary rate for the time worked.

The private-sector October holiday block combines the three October civic holidays into Semana Morazánica, a transferred three-day holiday period. In 2026 it runs from noon on 7 October to noon on 10 October. Different collective-agreement dates remain binding unless lawfully changed. The structured calendar groups this transferred block as one row so it is not mistaken for three independent full days beginning at midnight.

Equipment terms for home working

+−

A written remote-work agreement specifies who owns the equipment, how it can be used and how it must be cared for. General employment rules require the employer to provide suitable work tools unless the employee has agreed to use their own. The arrangement should distinguish company-owned equipment from a cash home-office allowance and state any return obligations.

StatutoryCountrywide

Connection costs for remote work

+−

A written remote-work agreement must specify how connection costs will be paid. This determines whether the employer pays the bill directly, reimburses an agreed expense or uses another agreed arrangement. The amount and eligible services follow the contract; the legal framework does not set a fixed monthly internet allowance.

StatutoryCountrywide

Remote and hybrid employment arrangements

+−

Honduran law permits employees to work wholly or partly away from the employer’s premises using information and communication technology. Telework employees retain the benefits and protections of comparable employees. The employer and employee agree the hours or activities to be performed while respecting statutory working-time limits.

A written telework agreement must address equipment ownership, use and care, payment of connection costs, ownership of transmitted information and how that information is stored. This framework permits remote or hybrid work; it does not give every employee an unconditional right to choose it.

Employer additionCountrywide

Agreed remote and hybrid work

+−

A remote-work arrangement lets an employee perform all or part of the job away from the office using digital communications. The agreement sets the work to be delivered, agreed hours and any office attendance. Remote employees retain comparable employment protections, and working-time limits continue to apply.

Hiring employees in Honduras: what affects benefits

Employment context that affects the benefit package.

StatutoryCountrywide

Employment status and independent services

+−

Employment status follows the actual working relationship. Personal services performed for pay under continuing direction or supervision constitute employment, whatever the agreement is called. Personal work is presumed to be governed by an employment contract. A genuine independent contractor controls the delivery of an independent service rather than working under continuing employer authority. Employee leave, bonus and dismissal protections must not be removed by labelling an employee a contractor.

Source: Labor Code

StatutoryCountrywide

Written employment contracts

+−

Employment contracts and amendments generally need to be written, with a copy retained by each party; the Labor Code provides limited exceptions for specified types of work. State the parties and identity details, services, start date and duration, workplace, working time, pay and payment arrangements, any accommodation, and the place, date and signatures. Use Spanish for workplace instructions and a Spanish contract, adding a translation when needed. Fixed terms are subject to legal limits and must fit the actual nature of the work.

Salary structure and payment intervals

+−

Professional and other intellectual employees must be paid at intervals no longer than one month; manual workers must be paid at least weekly. The agreed pay interval must stay within these limits. Monthly payroll is a practical structure for salaried professional roles. Salary, statutory extra payments, overtime, and authorized deductions should be identified according to their own rules.

Overtime and night-work premiums

+−

Overtime carries a 25% addition to the daytime rate when worked in daytime, a 50% addition to the daytime rate when worked at night, or a 75% addition to the night rate when it extends an ordinary night shift. Ordinary night work itself carries a 25% premium over daytime work. These are different calculation bases.

Ordinary and overtime hours together generally cannot exceed 12 a day; overtime is generally restricted to four occasions a week. Emergency and agricultural exceptions apply, and overtime is prohibited in inherently dangerous or unhealthy work. Work on a rest day or public holiday is paid at double the ordinary rate for the time worked, with the weekly rest protection retained.

StatutoryCountrywide

Working hours, shifts and rest

+−

The normal daytime limit is 8 hours a day and 44 hours a week, with the weekly remuneration equivalent to 48 hours. Daytime runs from 5 a.m. to 7 p.m. Night work is limited to 6 hours a day and 36 a week. A mixed shift is limited to 7 hours a day and 42 a week; a shift with at least 3 night hours counts as night work.

A continuous working day includes at least a 30-minute break counted as work. Employees receive at least 10 uninterrupted hours between working days and one rest day, preferably Sunday, after six working days. Special categories have separate exceptions.

Written probation of up to 60 days

+−

A probation period must be agreed in writing and cannot exceed 60 days. It is paid. A shorter period can be extended before it ends, but the combined period must remain within 60 days. During valid probation either party can end the relationship without notice or dismissal compensation, while other employee benefits remain due. If employment continues beyond probation it becomes indefinite. The same parties cannot restart probation for the same work through another contract within one year.

Dismissal grounds and remedies

+−

Termination must follow the legal grounds and process that apply to the contract. The Labor Code recognizes mutual agreement, lawful expiry, justified employer dismissal and specified other causes. A worker can challenge an unjustified dismissal and seek the applicable reinstatement or compensation remedy. Document the reason and supporting evidence; notice and severance are separate from the reason for ending employment.

StatutoryCountrywide

Termination notice and paid job-search time

+−

For indefinite employment, ordinary notice increases with continuous service: 24 hours below three months; one week from three to six months; two weeks from six months to one year; one month from one to two years; and two months beyond two years. Valid probation has separate rules.

Notice normally states the reason in writing and starts the following day. The employer can pay the salary for the notice period instead. An employee who fails to give required notice can owe half the corresponding salary. During employer notice, the employee receives one paid day each week to seek another job.

2026 progressive personal income tax

+−

For 2026, annual net taxable income is exempt through HNL 228,324.32. The next band, HNL 228,324.33–348,154.10, is taxed at 15%; HNL 348,154.11–809,660.75 at 20%; and income above HNL 809,660.75 at 25%. These are progressive bands applied to taxable income, not one rate applied to all gross salary.

The tax authority’s monthly salary illustrations add an annual HNL 40,000 medical-expense deduction before dividing by 12. On that stated illustration, salary through HNL 22,360.36 a month is exempt. The deduction is a tax calculation item, not an employer-paid medical allowance. Other deductions and the worker’s circumstances require their own payroll calculation.
