Benefits in Albania,
with the context that matters.
Albania combines compulsory social and health insurance with paid annual leave, maternity income and other employment protections. Employers can supplement this baseline with private insurance, retirement saving, flexible work and allowances. Independent contractors run their own registered activity and social protection; employment leave rights do not automatically apply to client contracts.
This guide covers employees and genuine independent contractors working in Albania. Employment protections apply to employees based on the substance of the relationship; self-employed professionals register and fund their own social protection. Employer benefits follow each plan’s eligibility and terms.

StatutoryCountrywideEmployees and independent contractors
+−
Employees and independent contractors
An employment relationship involves paid work within the organisation and under the instructions of an employer. The substance of the relationship determines employment protection; calling a worker a contractor does not remove employment duties. Part-time employees retain the rights of comparable full-time employees, with proportional treatment where a condition depends on working time. Genuine self-employed professionals arrange their own business registration and social protection.
StatutoryCountrywideWritten employment terms
+−
Written employment terms
Employment contracts must be in writing. They identify the parties, workplace, role, start date, fixed term if applicable, paid leave, notice, salary components and payment date, weekly hours, collective agreement, probation and disciplinary procedure. A special justified case without the written contract must be documented within seven days of starting work.
StatutoryCountrywideSalary payment and additional annual pay
+−
Salary payment and additional annual pay
Monthly salary is the normal payroll arrangement. Where pay is calculated by the hour, day or week, the Labour Code provides payment every two weeks unless a written agreement provides otherwise. A thirteenth-month salary is not a general statutory private-sector entitlement; an employment contract or collective agreement can create additional pay obligations.
StatutoryCountrywideMinimum monthly wage
+−
Minimum monthly wage
The national minimum gross monthly wage is ALL 50,000 from 1 January 2026. Employers must apply the legal wage floor before deducting employee contributions and income tax. The minimum also affects compulsory contribution calculations; the social insurance ceiling is a separate figure.
StatutoryCountrywideWorking time, rest and overtime
+−
Working time, rest and overtime
Normal working time is at most eight hours a day and 40 hours a week. Employees ordinarily receive at least 11 consecutive hours of daily rest and 36 hours of weekly rest, including 24 uninterrupted hours. Overtime is ordinarily limited to 200 hours a year and total work to 48 hours a week; exceptional averaging and authorised emergency rules apply. Pregnant employees and mothers until the child turns one must not work overtime. Ordinary overtime pays at least 125% of normal wages, or equivalent time off increased by 25% by agreement. Overtime on weekly rest days or public holidays receives at least 150% pay or equivalent enhanced time off. These overtime rules are distinct from compensation for scheduled work on holidays.
StatutoryCountrywideProbation and probation notice
+−
Probation and probation notice
The first three months of an indefinite employment relationship are normally probation unless the parties previously contracted for the same work. Written or collective agreement can shorten or remove probation. During probation, either party gives at least five days’ notice. Fixed-term probation must be agreed in writing and cannot exceed three months.
StatutoryCountrywideDismissal process, notice and job search leave
+−
Dismissal process, notice and job search leave
After probation, ordinary notice for an indefinite contract is two weeks up to six months’ service, one month above six months through two years, two months above two through five years, and three months above five years. Notice runs to the relevant week or month end. An employer considering dismissal gives at least 72 hours’ written notice of a meeting, hears the employee, and communicates the reasoned decision in writing 48 hours to one week afterwards. Failure to follow this procedure can add two months’ salary compensation. During employer-given notice the employee receives at least 20 paid hours a week to seek work. Unjustified dismissal can attract compensation of up to one year’s salary separately from notice and other rights.
Contractor benefits in Albania
Independent contractors are responsible for registering their activity and paying their own compulsory social and health contributions. Employee leave and employer-funded protections do not automatically apply to a client contract.
